1. Presentation of the website

Pursuant to Article 6 of French Act No. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN), users of this website (hereafter referred to as « the Site ») are hereby informed of the identities of the various people involved in its development and monitoring:

« EasyFoal » is a foaling detection system based on an analysis of the mare’s pre-foaling behaviour, over which Innoval has industrial and intellectual property rights, as part of its business line related to monitoring. In particular, Innoval is the owner of the semi-figurative trademark (verbal elements + logo) EasyFoal, registered with the INPI (France), EUIPO (European Union) and the IPO (United Kingdom), and the Site’s domain name. Therefore, the term EasyFoal covers all of these elements jointly.

2. General terms of use for the Site and the services proposed

2.1. Use of the Site implies full and unconditional acceptance of the general terms of use (« GTU ») set out below. These terms of use may be amended or supplemented at any time; therefore, users of the Site are invited to refer to them on a regular basis.

2.2. The Site is generally accessible to Users at all times. Innoval may, however, decide to interrupt access to carry out technical maintenance, in which case it will endeavour to inform Users in advance of the dates and times of the intervention.

2.3. The Site is updated by Innoval on a regular basis (e.g. list of training courses, design). Similarly, the legal notices may be amended at any time; they are nonetheless binding on the User, who is therefore advised to check them as often as possible.

3. Description of the services provided

3.1. Sections of the Site

The purpose of the Site is to provide information concerning:

  • an overview of EasyFoal;
  • how EasyFoal works;
  • a « Purchase EasyFoal » section;
  • a « News » section;
  • an « FAQ » section.

The Site also gives Users the ability to send a message to Innoval through the « FAQ » section.

3.2. Limitations relating to the Site’s content

3.2.1. Innoval endeavours to provide the most accurate information possible on the Site. However, Innoval may not be held liable for any omissions, inaccuracies or deficiencies in updates, whether of its own doing or that of a third party providing this information.

3.2.2. All the information provided on the Site is non-binding and subject to change. Moreover, the information appearing on the Site is:

  • not exhaustive;
  • subject to any amendments that may have been introduced since it was put online but that have not yet been updated on the Site.

4. Contractual limitations regarding technical data

4.1. The Site uses Drupal CMS technology.

4.2. The User undertakes to access the Site using recent hardware, which does not contain viruses, and an up-to-date latest-generation browser.

5. Intellectual property and infringement

5.1. Innoval owns the intellectual property rights or holds the rights of use pertaining to all the elements accessible on the Site, in particular all texts, images, graphics, logos, icons, sounds, and software.

5.2. Any reproduction, representation, modification, publication or adaptation of all or any of the Site’s elements, regardless of the means or process used, is prohibited without the prior and express written consent of Innoval.

5.3. Any unauthorised use of the Site or of any of the elements it contains will be considered as infringement and may be prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the French Intellectual Property Code.

6. Limitations on liability

6.1. Innoval cannot be held liable for direct or indirect losses (e.g. loss of market, loss of opportunity) caused, when accessing the Site, to the User’s hardware or computer equipment or to the data stored therein, or for the potential consequences for his/her personal, professional or commercial activity following use of the Site as a result of:

  • the use of hardware that does not comply with the specifications given in Article 4, « Contractual limitations regarding technical data », of the GTU,
  • or the occurrence of a bug or incompatibility. Innoval also may not be held liable if the User is unable to connect to the Site due to any technical failure or any problem occurring in particular due to a congested network.

6.2. Interactive areas. Interactive areas (ability to ask questions in the Contact area) are made available to the User. Innoval reserves the right to delete, without prior notice, any content posted to this area that infringes the applicable legislation and regulations in France, in particular the provisions relating to the protection of personal Data. Where appropriate, Innoval also reserves the right to engage the civil and/or criminal liability of the User, in particular in the event of any message of a racist, xenophobic, homophobic, anti-Semitic, offensive, defamatory, paedophilic or pornographic nature, regardless of the medium used (text, image, photography, etc.).

6.3. Notice on the security of the Site. In order to ensure the security of the Site and guarantee that it can be accessed by any User, Innoval uses software applications to monitor flows on the Site and to identify unauthorised attempts to connect or change information, or any other initiatives that may cause damage. Unauthorised attempts to upload or change information, with the aim of causing damage, and in general any effort to compromise the availability and integrity of the Site are strictly prohibited and subject to criminal penalties. In fact, fraudulently accessing or remaining in all or part of an automated data processing system is punishable, on the date of effect of the GTU, by two years of imprisonment and a €60,000 fine (Article 323-1, Paragraph 1, of the French Criminal Code). When this results in either the deletion or the modification of data contained on the Site, or impaired functioning of the Site, the penalty is three years of imprisonment and a €100,000 fine (Article 323-1, Paragraph 2, of the French Criminal Code). Fraudulently introducing data into an automated processing system or deleting or modifying the data it contains is punishable by five years of imprisonment and a €150,000 fine (Article 323-3 of the French Criminal Code).

7. Management of Personal Data

7.2. The sending of messages by Users to Innoval via the contact form is subject to challenge-response tests used in computing called « CAPTCHA » tests. A CAPTCHA is an automated program that protects websites by distinguishing between human users and robots. To do so, it generates tests that humans can pass but malicious computer programs cannot. These tests are thus intended to constitute security checks. For that purpose, the User is required to solve a simple mathematical problem in the following box:

Other information may also be collected when the User uses the Site: the URLs of the links through which the User has accessed the Site, the User’s access provider, and the User’s Internet Protocol (IP) address. In any event, Innoval collects these Personal Data exclusively for the purposes of certain services offered by the Site. Moreover, the User is advised to read the Personal Data Protection Policy by clicking on the aforementioned URL link.

8. Hyperlinks and cookies

8.1. Hyperlinks. The Site may contain hyperlinks to other websites that have been installed with Innoval’s consent. However, Innoval is not able to verify the content of the sites visited through these hyperlinks and therefore cannot be held liable for such content.

9. Photo Credits

9.1. All photographs, icons and illustrations on the Site are the exclusive property of:

  • Innoval or,
  • an entity affiliated with the Innoval Group.

9.2. Any reproduction, whether in part or in full, or any distribution or sale of these visuals, in their original form or a derived form, in particular for advertising purposes, is strictly prohibited without the prior written consent of Innoval. Subject to prosecution, the User may not distribute, reproduce or sell, whether in its original form or a derived form, any content of the Site.

9.3. However, the User may print information from the Site, provided that Innoval is expressly named as the author of this information.

10. Applicable law and settlement of disputes

10.1. Any dispute relating to the use of the Site or the interpretation or enforcement of these legal notices and GTU shall be subject to French law.

10.2. When attempts to amicably resolve a dispute have failed, jurisdiction shall be attributed to the civil courts of Rennes (Ille-et-Vilaine, France), unless the matter falls within the jurisdiction of another public authority.

11. Glossary

User : means the Internet user who connects to and uses the Site.

Personel Data : means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person (Article 4 of General Data Protection Regulation (EU) 2016/679 of 27 April 2016, applicable since 25 May 2018 [« GDPR»] and French Act No. 2018-493 of 20 June 2018 on the protection of personal data, amending the French Data Protection Act of 6 January 1978).

Data controller : means « the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data » (Article 4 (7) of the GDPR).
